IMPORTANT: These Terms of Service contain critical research-use restrictions, buyer warranty clauses, and liability limitations specific to the supply of research compounds. This is not a generic e-commerce template. Every user must agree to these terms before placing an order.

 

These Terms of Service (“Agreement”) govern your access to and use of the BioPerform website located at www.bioperform.ca (“Site”) and the purchase of any products offered therein. By accessing this Site, registering for an account, or placing an order, you agree to be bound by this Agreement in full. If you do not agree, do not use this Site.

BioPerform supplies research-grade peptide compounds exclusively to licensed researchers, qualified professionals, and accredited institutions for in vitro laboratory research purposes. These products are not approved for human consumption, medical use, or diagnostic purposes. Access to this Site is restricted to approved account holders only.

 

 

  1. Eligibility and Researcher Warranty

By registering for an account and placing an order, you represent, warrant, and confirm the following without qualification:

  •   You are at least 21 years of age.
  •   You are a licensed researcher, qualified scientific professional, or authorized representative of an accredited research institution or laboratory.
  •   You have the knowledge, training, and facilities required to safely handle, store, and use research-grade peptide compounds.
  •   You will use all products purchased from BioPerform exclusively for in vitro laboratory research purposes.
  •   You will not purchase, possess, use, distribute, or resell any BioPerform product for human consumption, personal use, therapeutic purposes, or any application other than in vitro research.
  •   You have reviewed and understand the applicable regulations governing the possession and use of research compounds in your jurisdiction.

 

BUYER WARRANTY

Your use of this Site and placement of any order constitutes an active, binding warranty that all of the above representations are true and accurate at the time of purchase and remain true throughout your use of BioPerform products. BioPerform relies on this warranty in approving your account and fulfilling your orders. Any misrepresentation voids this Agreement and may result in immediate account termination.

 

 

  1. Research Use Only — Absolute Restriction

All products offered by BioPerform are supplied strictly and exclusively for in vitro laboratory research use. This restriction is absolute and non-negotiable.

 

ALL BIOPERFORM PRODUCTS ARE FOR IN VITRO RESEARCH USE ONLY. THEY ARE NOT FOR HUMAN CONSUMPTION, ANIMAL USE, MEDICAL USE, DIAGNOSTIC PURPOSES, OR ANY FORM OF SELF-ADMINISTRATION. ANY FORM OF BODILY INTRODUCTION INTO HUMANS OR ANIMALS IS STRICTLY PROHIBITED.

 

Products sold by BioPerform are not drugs, food products, cosmetics, or medical devices unless explicitly stated otherwise. They have not been evaluated, approved, or licensed by Health Canada, the FDA, or any other regulatory authority for human or animal use.

Purchasing a product from BioPerform does not constitute authorization, recommendation, or guidance for any use other than in vitro laboratory research.

 

 

  1. Account Registration and Approval

Access to the BioPerform catalog and the ability to place orders requires registration and manual approval of your account. By registering, you agree to:

  •   Provide accurate, complete, and current information about your professional qualifications and research affiliation.
  •   Notify BioPerform immediately if any information provided during registration becomes inaccurate or changes.
  •   Maintain the confidentiality of your account credentials and accept responsibility for all activity conducted under your account.

 

BioPerform reserves the right to deny, suspend, or terminate any account at its sole discretion, including accounts where misuse is suspected or where the buyer’s qualifications cannot be verified.

 

 

  1. Buyer Responsibility and Assumption of Liability

By purchasing any product from BioPerform, you expressly acknowledge and accept the following:

  •   You assume full and sole responsibility for the safe handling, storage, use, and disposal of all products in accordance with applicable laws, regulations, and professional standards.
  •   You have independently assessed the risks associated with the compounds you are purchasing and have the expertise to handle them safely.
  •   You are responsible for ensuring that your use of BioPerform products complies with all federal, provincial, and local laws and regulations applicable in your jurisdiction.
  •   You will not use BioPerform products as food additives, drugs, household chemicals, cosmetics, or for any recreational, personal, or commercial purpose.
  •   You accept full liability for any harm, damage, loss, or legal consequence arising from your purchase, possession, handling, use, or distribution of BioPerform products.

 

ACKNOWLEDGMENT OF RISK

Research-grade compounds carry inherent risks when mishandled. By purchasing from BioPerform, you confirm you understand those risks and are equipped to manage them within a professional research environment.

 

 

  1. Limitation of BioPerform Liability

BioPerform supplies compounds for in vitro research use only. We do not control how products are used once they leave our facility. Accordingly:

  •   BioPerform is not liable for any injury, illness, adverse reaction, or harm arising from the use of any product in a manner inconsistent with its stated research-only purpose.
  •   BioPerform is not liable for any harm resulting from human or animal administration of any compound, regardless of whether such administration was intentional or accidental.
  •   BioPerform’s total liability for any claim arising under this Agreement shall not exceed the purchase price paid for the specific product giving rise to the claim.
  •   BioPerform shall not be liable for any indirect, incidental, consequential, special, or punitive damages of any kind.

 

By completing a purchase, you agree to indemnify, defend, and hold harmless BioPerform, its directors, officers, employees, and suppliers from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your purchase, possession, or use of BioPerform products, or your breach of this Agreement.

 

 

  1. Orders, Payment, and Fulfillment

All orders are subject to account approval and product availability. BioPerform reserves the right to refuse or cancel any order at its discretion.

At checkout, choose credit card or Interac e-Transfer. Card orders confirm instantly. For e-Transfer, send payment to support@bioperform.ca with your order number and save 3%. 

  1. All Sales Final — No Returns

Due to the controlled storage requirements and research integrity standards required for these compounds, all sales are final. BioPerform does not accept returns.

If your order arrives with missing, incorrect, or visibly damaged items, contact support@bioperform.ca promptly with your order details. BioPerform will assess and address verified fulfillment errors at its discretion.

 

 

  1. Shipping and Delivery

Orders placed and paid before 2 PM MT on business days are typically shipped the same day via Canada Post Express or Purolator. Orders placed after 2 PM MT, on weekends, or on holidays will be dispatched the following business day.

Free shipping is available on research orders totalling CAD$300 or more (excluding promotions, discounts, and applicable taxes). Shipping rates are otherwise calculated at checkout.

BioPerform is not responsible for delays caused by the carrier, customs, or circumstances beyond our control once an order has been dispatched.

 

 

  1. Intellectual Property

All content on this Site, including text, graphics, logos, product images, and code, is the property of BioPerform and is protected by applicable copyright and trademark laws. You may not reproduce, republish, distribute, or commercially exploit any content from this Site without the prior written consent of BioPerform.

You may download or print materials from this Site for personal, non-commercial reference only, provided content is not altered and all proprietary notices are retained.

 

 

  1. Privacy

BioPerform collects and uses personal information in accordance with its Privacy Policy, available at www.bioperform.ca/privacy-policy. By using this Site, you consent to the collection and use of your information as described in that policy.

 

 

  1. Amendments and Governing Law

BioPerform reserves the right to update or amend these Terms of Service at any time. Amendments take effect upon posting to this Site. Continued use of the Site following any amendment constitutes acceptance of the revised terms.

These Terms of Service are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of Alberta.
